Appeals

The CVRP Registration Committee reviews applications of appeal from Appellants contesting decisions of the Registrar or Assistant Registrar pertaining to credential eligibility, exam sitting, grade assigned &/or continuing education units.

Appeal Procedures

An Appellant has 60 days to appeal a decision.

  1. An application for appeal & fee must be submitted.
  2. The appeal will be reviewed by the Registration Committee whose decision is final & binding.
  3. The decision & reasons are given in writing by the Committee to the Registrar & Appellant within 90 days.
  4. The Committee may refuse to conduct a review if the appeal is frivolous or an abuse of process.
  5. The Committee may extend the 60 day time period allowed to submit an appeal if satisfied there are reasonable grounds. The period of time granted for the extension will be provided in writing to the Registrar & Appellant.
  6. The Committee will ensure the Appellant is given opportunity to review & make submissions in respect of any document the Committee intends to consider in making a decision.
  7. The Committee may lawfully withhold the release of a document where, following a duly conducted risk assessment, it reasonably determines that disclosure would foreseeably endanger the safety or constitute an unwarranted invasion of personal privacy of any individual identified therein.
  8. The Committee need not hold a hearing or afford to any Appellant an opportunity for a hearing before making a decision or providing a direction.
  9. The Committee, after considering the Appellant’s appeal, written submissions & any documentation considered relevant, may make an order in accordance with Registration Policy, Examination Policy &/or Continuing Education Policy.

Registration

The Registration Committee will review applications for appeal from an Appellants who has been denied registration by the Registrar or Assistant Registrar.

The Appellant’s Application for Appeal may consider the following criteria:

  1. Related degrees.
  2. Demonstrated knowledge, through education & experience of  core competencies & domains of learning.
  3. Employment experience.
  4. Previous past conduct that resulted in removal of registration/certifications in other organizations, regulatory colleges or associations.
  5. False or misleading statement(s) or representation(s) in the application for registration.
  6. Whether the Appellant has been advised they does not fulfill the requirements of the Standards, Bylaw or Policies set by the College.

Examinations

The Registration Committee will review applications for appeal from Appellants who has been denied to write the certification examination or has concerns regarding the process of sitting the examination or the final grade assigned.

There is a zero tolerance for cheating or inappropriate behaviour during any examination sitting. An applicant must sit the examination within one year of application submission.

The Appellant’s Application for Appeal may consider the following criteria:

  1. Denial of the application to write the examination if applicant did not provide one or more of the documents outlined in the application process &/or if  applicant has been denied a refund of the non-refundable application fee. 
  2. The Appellant is denied the opportunity to write the certification examination if the Registrar considers eligibility criteria has not been met.
  3. The Appellant requested accommodations in the writing of the examination & feels that these were not sufficiently provided.
  4. The Appellant questions the final certification examination grade assigned.

Continuing Education Units (CEUs)

The Registration Committee will review appeal applications from Appellants who have been denied in part or all of the requested &/or submitted CEUs.

The Appellant’s Application for Appeal may consider the following criteria:

  1. The educational event must be applicable to the core competencies & domains of learning.
  2. The prescribed time period of 2 years for submission of CEUs.
  3. Prescribed documentation submitted with the pre-approval application.
  4. Prescribed documentation submitted with the post-approval application.
